Booking Terms & Conditions

DEPOSIT
a. A 50% deposit is required at the time of booking to confirm the charter or limousine service. -
FINAL PAYMENT
a. The balance of the service fee is to be received as cleared funds no later than 7 days prior to the service date. -
CANCELLATION
a. If the service is cancelled in writing more than 7 days prior to the service date, a full refund will be made minus a $250 administration fee.
b. If the service is cancelled within 7 days of the service date, a 100% cancellation fee will apply. -
SECURITY BOND
a. A bond of $2,500 is required prior to the service date for boat charters only, refundable within 5 business days after the service, provided no damage or excessive cleaning is required. No bond is required for limousine services.
b. The bond may be withheld or additional charges applied if:
i. There is damage to the vehicle, vessel, or its fittings caused by the client or guests.
ii. The vehicle or vessel requires excessive cleaning beyond normal use.
iii. Any legal penalties (e.g., fines for smoking violations) are incurred during the service.
c. The cost recovery for damages is not limited to the bond amount. -
LIMIT OF LIABILITY
a. The liability of the Operator, its agents, and subcontractors is limited to the maximum extent permitted under New Zealand transport and maritime laws. -
INDEMNITY
a. The Client agrees to indemnify and hold harmless the Operator, its agents, and employees from any losses, claims, or damages resulting from:
i. Any negligent or reckless act by the Client or their guests.
ii. Damage, loss, or theft of personal property during the service.
iii. Personal injury or death caused by the Client's or guests' actions.
b. The Operator agrees to indemnify the Client against any losses arising from the Operator's negligence, excluding those outlined above. -
WEATHER & TRAFFIC CONDITIONS
a. The Operator is not responsible for weather or traffic delays. Delays due to unforeseen circumstances (e.g., road closures, extreme weather) do not entitle the Client to refunds or compensation. The Operator will make reasonable efforts to provide alternate solutions if possible.
b. For boat charters, we reserve the right to cancel any service due to extreme weather conditions if deemed unsafe by the captain. In such cases, a 100% refund will be provided, or you may reschedule the charter at your convenience, subject to availability. Your safety is our top priority. -
SUITABILITY OF VEHICLE OR VESSEL
a. By confirming the booking, the Client acknowledges satisfaction with the suitability of the vehicle or vessel for their intended purpose. -
SPECIAL CONDITIONS
a. Smoking is strictly prohibited in all vehicles and vessels. A $1,000 fine applies for violations.
b. Consumption of alcohol is permitted only if agreed in writing and in compliance with local laws. Intoxicated passengers may be refused entry or service.
c. Food is not permitted in the vehicles or vessels unless previously arranged. -
EXTENSION OF SERVICE TIME
a. Service time may be extended by mutual agreement, subject to availability. Additional fees will apply and must be settled immediately. -
SAFETY – DRIVER’S OR CAPTAIN’S AUTHORITY
a. The Client and guests must comply with all instructions from the driver or captain regarding safety and conduct.
b. The driver or captain reserves the right to terminate the service immediately if the safety of the vehicle, vessel, or passengers is at risk, or if passengers refuse to comply with instructions. No refunds will be provided in such cases.
c. The maximum number of passengers must not exceed the legal limit specified for the vehicle or vessel. -
LIABILITY OF SIGNATORY
a. The person signing this agreement acknowledges they do so on behalf of all passengers and are responsible for all payments and conduct during the service. -
OPERATOR'S RESPONSIBILITIES
a. The Operator agrees to maintain all vehicles and vessels in safe, roadworthy, and seaworthy condition in compliance with New Zealand transport and maritime authority regulations. -
GOVERNING LAW
a. This Agreement shall be governed by and construed in accordance with the laws of New Zealand. The parties submit to the exclusive jurisdiction of the courts of New Zealand. -
DEFINITIONS
a. AGREEMENT refers to this contract between the Operator and Client.
b. DRIVER refers to the individual operating the limousine or vehicle.
c. CAPTAIN refers to the master of the vessel which is subject to the charter.
d. CHARTER refers to the provision of transport services for the agreed period.
e. CLIENT refers to the person responsible for payment and guests during the service.
